The Law on Environmental Protection in 2020 was approved by the XIV National Assembly at its 10th session on November 17, 2020, and took effect on January 1, 2022. On January 10, 2022, the Prime Minister issued Decree No. 08/2022/ND-CP detailing a number of articles of the Law on Environmental Protection (Decree 08).

The Law on Environmental Protection as well as Decree 08 has many new points compared to the Law on Environmental Protection 2014. Including regulations on costs of collection, transportation and treatment of domestic solid waste.

In response to this year’s World Environment Day (June 5) with the theme of the United Nations Environment Program (UNEP) launched with the theme “Only One Earth” and to clarify the above regulation, on the morning of On June 3, the Journal of Environment and Urban held a seminar with the topic: “Cost of collection, transportation and treatment of domestic solid waste”.

At the seminar, the Organizing Committee and the speakers spoke and clarified the following issues: Is there any difference between the calculation of the cost of services of collection, transportation and treatment of domestic solid waste according to the new regulations? ? What is correct calculation, sufficient calculation? According to which method is the calculation of the service charge of collection, transportation and treatment of domestic solid waste done? What are the advantages and disadvantages of related units in formulating service charges for collection, transportation and treatment of domestic solid waste? Japan’s experience in charging the above service…

The presentation report of Urban Environment Company in provinces and cities such as: Lao Cai, Hanoi, Thua Thien Hue, Can Tho and Ho Chi Minh City mentioned many issues surrounding the collection work. , transportation and waste treatment.

Specifically, Lao Cai Urban Environment Joint Stock Company has applied information technology, digitized the map of waste collection and transportation routes; supervise the collection and transportation of waste and the classification of waste at source; using computer software to collect service fees for domestic solid waste collection and transportation by smart mobile devices in a seamless process, integrating electronic invoices.

However, Lao Cai province also has no sanctions for non-payment or incomplete payment of service charges; the unit performing the service charge collection has not yet calculated a percentage from the collected amount.

Referring to the service price, a representative of Hue Urban Construction and Environment Joint Stock Company said that the People’s Committee of Thua Thien Hue province has issued a decision No. 2239/QD-UBND stipulating: When the input price (as wages, gasoline prices, oil prices) specified in this decision have continuous fluctuations lasting within 60 days, causing a large price difference as the unit price (cost of solid waste collection, transportation and treatment services). living) is reduced by 10% or increased by 20% or more or the State policy on salary, management, setting unit price of public services changes, the Department of Construction advises the Provincial People’s Committee to adjust accordingly. .

However, for many years now, the consultation to adjust the unit price has not been implemented, causing difficulties for public service providers in negotiating and contracting with agencies, organizations and customers that do not use the budget. The state affects the policy regime for employees.

Recyclable waste such as paper, bottles and cans increases, creating an input source for the recycling industry, increasing revenue for collection and treatment and increasing income for workers.

In Ho Chi Minh City, service prices for collection, transportation and treatment of domestic solid waste are inconsistent and inappropriate. Due to decentralization to district-level People’s Committees to issue specific rates for services of collection, transportation and treatment of domestic solid waste, applicable to individuals, households, and local waste source owners. Each locality issued a different level, creating a lack of synchronization and consistency across the city. The price of manual collection service, which is 2 times higher than the price of mechanical collection, has discouraged businesses from investing in technological innovation and modern equipment to increase productivity and reduce heavy labor for workers. .

Mr. Pham Van Duc – Deputy General Director of Hanoi Urban Environment Company Limited said that: In Hanoi, there are still some shortcomings and difficulties in unit prices (according to Decision 453/QD-UBND). presented at the Workshop, from which it was proposed to issue a price (according to the report 399/Ttr-SXD) to ensure 100% collection of service fees for maintaining environmental sanitation according to the criterion “polluters must pay”. moneyā€¯ of the Law on Environmental Protection 2020.

When the environmental service fee is increased, the collection and transportation unit is allowed to refuse to provide the service in case of non-compliance with regulations. At that time, there will be cases of individuals disposing of garbage improperly. To solve this situation, it is necessary to strengthen the sanction according to the provisions of Decree No. 55/2021/ND-CP.

After analyzing the current situation of costs of collection, transportation, and treatment of domestic solid waste, the opinions presented at the seminar gave many specific recommendations:

Firstly, the relevant ministries and sectors need to study and issue methods and procedures for determining and managing the cost of services of collection, transportation and treatment of domestic solid waste so that the localities can develop and adjust the application. fast, convenient price. There should be specific regulations on the level of revenue, support and compensation rates from the local budget, which are uniform across the country for each type of urban area. Regulations on compensation for loss of revenue.

Second: There are sanctions for those who do not separate waste at source, do not pay for the service of collection, transportation and treatment of domestic solid waste.

Third: Responsibilities of relevant agencies, organizations and individuals such as: People’s Committees at all levels, relevant functional agencies, street leaders and service users.

Fourth: In the service cost structure, it is necessary to have an appropriate percentage to foster workers who directly collect, transport and treat daily-life solid waste, at the same time, so that businesses can have favorable conditions. invest in technological innovation, increase labor productivity, and reduce heavy labor for workers.

The discussion is an opportunity for the Vietnam Association of Urban Environment and Industrial Parks to use as a basis to gather opinions from the units, from which the written proposal to the competent authorities should be considered and promulgated soon. economic-technical norms, cost norms for services of collection, transportation and treatment of domestic solid waste in the spirit of the Law on Environmental Protection and Decree 08.
